Abstract
Залежно від виду формату, він складається з різної комбінації елементів – об’єктів права інтелектуальної власності та так званих утилітарних елементів, котрі не захищаються правом. Юридична конструкція формату як складного об’єкта права інтелектуальної власності потребує визначення елементів, які входять до його складу, а також підходів до охорони елементів національним та міжнародним законодавством. Кількість елементів формату варіюється залежно від етапу розробки формату. На першому етапі (розробки) формат, як правило, є суто сценарієм, що входить до об’єктів авторського права. Проте, якщо формат вже реалізується у вигляді телевізійної програми на національному або міжнародному рівні, то до його складу входять різноманітні елементи. Формати, які є складними об’єктами права інтелектуальної власності, пов’язані з такими процесами, як адаптація, локалізація, глобалізація. Depending on the type of format, it is composed of different combinations of elements – the objects of the right of intellectual property and the so-called utilitarian elements that are not protected by law. Legal construction of the format, as a complex object of intellectual property rights requires the definition of elements that are part of its structure, as well as approaches to the protection of the elements of national and international legislation. The number of elements of the format varies depending on the stage of format development. At the first stage (the development) the format, as a rule, is essentially a script, which is included in the objects of copyright. However, if the format is implemented at the international level, it includes a variety of elements. Formats, which are complex objects of intellectual property rights, are connected with such processes as adaptation, localization, globalization.
