Визначено структуру, основні компоненти, функції, види та рівні правосвідомості. Сучасне суспільство знаходиться на етапі глобального переходу до нового технологічного ладу, особливості якого визначаються не тільки змінами у технологіях, але й станом суспільних інститутів. Поява, створення й широке практичне застосування революційних технологій (штучний інтелект, доповнена реальність, технології блокчейн, аналітичні структури на основі Big Data, самокеровані системи Smart Everything та ін.) формує нову «цифрову екосистему», в якій не може залишитися незмінною система права. The paper considers the scientific views on the issue of legal conscience. The structure, components, functions, types and levels of legal conscience are studied. Modern society is at the stage of global transition to a new technological order, the features of which are determined not only by changes in technology, but also by the state of public institutions. The emergence, creation and widespread practical application of revolutionary technologies (artificial intelligence, augmented reality, blockchain technologies, analytical structures based on Big Data, self-managed Smart Everything systems, etc.) creates a new "digital ecosystem" in which the legal system cannot remain unchanged.Item ПИТАННЯ ОДНОРІДНОСТІ ЗУСТРІЧНИХ ВИМОГ, ВИРАЖЕНИХ В РІЗНИХ ВАЛЮТАХ: ТЕОРЕТИКО-ПРАВОВИЙ АНАЛІЗ. ISSUES OF SIMILARITY OF COUNTERCLAIMS EXPRESSED IN DIFFERENT CURRENCIES: THEORETICAL AND LEGAL ANALYSIS(2020) ГЛОБА Анастасія Олександрівна; HLOBA Anastasiia Oleksandrivna; ЦЮПРИК Володимир Ігорович; TSIUPRYK Volodymyr IhorovychСтаттю присвячено розгляду проблеми визначення змісту однорідності зустрічних вимог, виражених в іноземних валютах. Автори з’ясовують, чи можна вважати однорідними зустрічні вимоги, виражені у різних валютах, за яких умов теоретично можливо здійснити зарахування таких вимог, а також якими є законодавчі підстави, що роблять можливим здійснення такого зарахування. У ході дослідження автори приходять до висновку, що зустрічне зарахування однорідних вимог при їх зарахуванні в іноземній валюті законодавством України чітко не встановлено. Авторами наведений підхід, відповідно до якого у випадках, коли законодавство надає право суб’єктам здійснювати розрахунок в іноземній валюті, таке зарахування є можливим. На основі дослідження вироблені пропозиції до вдосконалення законодавства задля усунення наявних прогалин і його застосування. The work considers the problem of similarity determination of counterclaims, expressed in different currencies. Offset of similar counterclaims is one of the grounds for termination of obligation, established by the Civil Code of Ukraine. However, the Code does not consider main conditions of an offset, as well as it does not give an interpretation of “similarity” of counterclaims. Moreover the issue of similarity of counterclaims, expressed in different currencies is not examined enough by doctrine, as well as not established in legislation. That is the reason why case law has to form its own position on this issue. Pursuant to analysis made in this work, authors came to the conclusion that theoretically under certain terms setoff of counter claims expressed in different currencies can be made. Authors also make suggestions for improvement of legislation and elimination of contradictions in law enforcement. That is why authors offer to provide in legislation the possibility of making offset of counterclaims, expressed in different currencies. У роботі представлено аналіз науково- методичних підходів стосовно трактування сутності поняття «капітал» та «капітал підприємства». Запропоновано визначення капіталу підприємства, принципи управління ним та механізм управління капіталом підприємства, який складається із таких систем: регулювання фінансової діяльності підприємства, зовнішньої підтримки фінансової діяльності підприємства, фінансових важелів, фінансових методів та фінансових інструментів. The enterprise's capital is the basis of its activities, the basis for the formation of proper financial and property support of economic activity and the bedrock of financial autonomy, solvency, and stability. Запропоновано в якості основної характеристики використовувати інтегральний показник соціально-економічного становища суб’єктів України. Для побудови узагальненого показника використані дані державної статистики. Ранжування і кластеризація регіонів країни за відібраними показниками дають змогу більш точно визначити найбільш розвинені. На основі кореляційного та регресійного аналізу побудована багатовимірна нелінійна модель прогнозування рівня доходів населення України. The issue of the country's socio-economic development and analysis of its dynamics arises within the context of the transition to a market economy. The aim of the research is to consider the state of socio-economic development of the regions of Ukraine on the basis of the generalized multicriteria indicator, cluster analysis, as well as the multidimensional nonlinear regression model. To trace the presence of differentiation in the socio-economic development of the regions of Ukraine is especially important. The analysis implemented in the Thesis covers the widest range of indicators of the socio-economic condition of the regions of the country. An integral indicator of the socio-economic condition of the subjects of Ukraine has been offered as the main characteristic. Окреслено найбільш привабливі напрями функціонування підприємства стосовно управління якістю продукції в умовах глобалізації. Обґрунтовано короткострокові та довгострокові цілі подальшого розвитку суб’єкта підприємницької діяльності та окреслено шляхи їх досягнення. he paper examines and substantiates the need to introduce a systematic approach to rational quality management as a key element of a modern, efficient and effective management system of the business entity, in order to improve financial and economic results through the production of higher quality products. The main system processes of product quality management and the algorithm of their implementation are considered as the most important elements of the organizational and economic mechanism of functioning of the business entity in the context of globalization. It was determined that in the European integration processes of the quality management system able to ensure the formation of not only a competitive advantage, but also sustainable development. Визначено структуру організаційно-інституціонального середовища фінансового механізму державно-приватного партнерства. З’ясовано основні перешкоди для його ефективного розвитку. Аргументовано, що процес формування та функціонування такого середовища потребує не тільки фінансової підтримки, але й консультаційної та інформаційної допомоги. Це дасть змогу підвищити результативність діяльності органів та інституцій у сфері державно-приватного партнерства. To ensure the proper functioning of the financial mechanism of public-private partnership, it is necessary to create an organizational and institutional environment. Without it, it is impossible to determine the most important vectors of development of this mechanism, as well as the benchmarks by which the formation and selection of the most effective economic and social institutions. It is substantiated that the effectiveness of the financial mechanism of public-private partnership depends on the organizational and institutional environment, which clearly regulates the rights, responsibilities, sequence of actions reflected in coordinated legislation and allows to take into account the specific regional or sectoral characteristics of the country.Item
