Обрана тематика є досить актуальною для реалій функціонування вітчизняних підприємств оскільки саме ефективна стратегія розвитку є основною запорукою максимізації прибутку у результаті досягнення запланованих цілей із задоволення потреб споживачів за мінімальних витрат. У статті визначено найбільш результативні інструменти управління стратегічним розвитком підприємства у сучасних умовах господарювання та фактори зовнішнього середовища, які впливають на ефективність їх використання. The paper is devoted to the study of the main aspects of managing the strategic development of the enterprise in conditions of economic instability. The chosen topic is quite relevant for the realities of the functioning of domestic enterprises because it is an effective development strategy is the main guarantee of profit maximization as a result of achieving the planned goals to meet the needs of consumers at minimal cost. The paper identifies the most effective tools for managing the strategic development of the enterprise in modern business conditions, which include: strategic planning. PROTECTION OF THE LABOR RIGHTS, FREEDOMS AND SOCIAL INTERESTS IN THE CRIMINAL LAW: EXPERIENCE OF FOREIGN COUNTRIES(2020) ЛИСЬКО, Тетяна Давидівна; LYSKO, Tetiana DavydivnaУ статті з використанням порівняльно-правового методу здійснено аналіз окремих положень кримінального законодавства зарубіжних країн, що забезпечують захист трудових прав, свобод та соціальних інтересів. Автором констатовано, що охорона трудових прав в сучасному кримінальному законодавстві зарубіжних країн нерідко носить досить фрагментарний, несистемний характер. Вказано вади вітчизняного законодавства та підкреслено основні позитивні зрушення в цій царині з прийняттям КК України 2001 р. Зроблено висновок, що перелік злочинів проти трудових прав, які передбачені в сучасних кримінальних законодавствах, достатньо потужний, характеризується специфічними ознаками та в окремих випадках може слугувати орієнтиром для вдосконалення українського кримінального законодавства. The analysis of certain points of the criminal legislation of the foreign countries, which provide protection of labour rights, freedoms and social interests, is made in the paper with the help of comparative legal analysis. Despite the quite wide legal regulation of labour relations in all countries in the world, the special criminal law protection of labour rights has remained a feature of "eastern" countries of the continental family of law mainly, the so-called post-socialist family of law. The analysis of criminal legislation of foreign countries regarding criminalization of the violation of labour rights of a person is conducted in the paper. Comparative-legal analysis allows defining general approaches to formation of labour rights of employees, including in the sphere of contractual relationship. INTERNATIONAL EXPERIENCE AND PRIORITY DIRECTIONS OF COMBATING TAX EVASION, TAXES AND OTHER MANDATORY PAYMENTS IN UKRAINE(2020) ЛІТВІНОВА, Ірина Феофанівна; LITVINOVA, Iryna Feofanivna; СОЛОМ’ЯНИЙ, Юрій Вікторович; SOLOMIANYI, Yurii ViktorovychУ статті проаналізовано законодавство деяких зарубіжних країн щодо відповідальності за злочини у сфері оподаткування.Встановлено, що загалом розвинені країни побудували надійні системи заходів забезпечення надходження податків до державного бюджету і застосовують дієві механізми притягнення до відповідальності за порушення вимог законодавства у галузі оподаткування. Визначено, що в законодавстві розвинутих зарубіжних країн за ухилення від сплати податків передбачено різні види відповідальності як наслідок антифіскальної поведінки платника податків: цивільну, адміністративну та кримінальну. Запропоновано, що для подолання проблеми , необхідно впровадити (за деякими видами порушень) залежність розміру фінансових санкцій від характеристики податкового правопорушення, його величини у грошовому вираженні, наявності чи відсутності наміру ухилення від оподаткування тощо. The paper analyzes the legislation of some foreign countries on liability for crimes in the field of taxation. Domestic tax control is characterized by a tendency to converge with European requirements, but the pace of reform of the tax administration system in Ukraine is too slow. It is suggested that to overcome the problem, it is necessary to introduce (for some types of violations) the dependence of the size of financial sanctions on the characteristics of the tax offense, its value in monetary terms, the presence or absence of intent to evade taxation and so on. Finally, abandon the link between the size of financial sanctions and the economically outdated value of the tax-free minimum income; to provide financial responsibility of legal entities for conducting accounting and tax accounting with violations (the current domestic legislation provides insignificant fines for bringing to administrative responsibility only officials of the taxpayer-legal entity).Item ОРГАНІЗАЦІЙНІ ІННОВАЦІЇ ІНТЕГРОВАНОЇ СИСТЕМИ МЕНЕДЖМЕНТУ ПІДПРИЄМСТВ СФЕРИ ГОСТИННОСТІ ТА ТУРИЗМУ. Вивчення інновацій у сфері послуг ще перебуває у зародковому стані, оскільки перші дослідження з'явилися тільки в кінці 1990-х рр. і знайти надійну теоретичну базу для вивчення інновацій у цьому секторі складно. Дане дослідження спрямовано на вирішення загального питання: як пояснити інновації в туристичному секторі. У пошуках відповіді на це питання у роботі ставляться дві мети: 1) обговорити, що таке інновації у сфері послуг, беручи до уваги вивчення інновацій у сфері гостинності та туристичних фірмах поряд з поданням огляду літератури; 2) розробити тематичне дослідження стосовно до міжнародної групи з питань гостинності. Результати підтверджують гіпотези про те, що впровадження Інтегрованої системи управління готелем є важливим нововведенням у тому сенсі, що вона сприяє головним чином організаційним інноваціям, а фірми використовують політику сталого розвитку як стратегії інновацій та диференціації від конкуренції. Organizational innovations of the integrated management system for hospitality and tourism companies is now an essential factor in the economic competitiveness of firms. The study of innovations in the service sector is still in its infancy, as the first studies did not appear until the late 1990s, and it is difficult to find a reliable theoretical basis for studying innovations in this sector. It becomes even harder to find when applied to firms working in the hospitality and tourism sectors. A certain topic is relevant for the formation of the company's human resources potential, because it is a source for new innovative ideas and new prospects for any organization. The purpose of the paper is to highlight the modern features of using prelim-ing in domestic enterprises, determine its advantages for a young specialist and study the impact of technology on the competitive development of organizations. The paper defines the positive and negative aspects of preliminaring technology.It is determined that students are inspired to do more, are not afraid to take risks and spend their time on achieving the goal, they are dynamic, effectively comprehend production processes, better perceive innovations, and are enthusiastic, so the inclusion of such a workforce will have a positive impact on the activities of any enterprise. In the research process was considered the probability of introducing preliminaring in the activities of the national stevedoring LLC "Brooklyn-Kiev" and the scheme of the key management stages of implementation preliminaring in the activities of the stevedoring company. It is noticed that the use of preliminaring in the stevedoring company gives an opportunity for the new employee assigned with the use of this technology, adapt to the specifics of the enterprise, production process, corporate culture prevailing in the organization since he's already interned at this company and is familiar with its organizational structure, individual links of the work team. The paper provides recommendations for the effective use of this technology in the activities of innovation-oriented organizations. Досліджено зміст та послідовність комерційних процесів за їх різновидами. Обґрунтовано функції управління комерційними процесами. Побудована схема взаємодії основних функціональних процесів комерційної діяльності. Сформовано організаційно-методичні підходи побудови ефективної системи управління комерційними процесами торговельного підприємства. Розроблено параметри оцінки умов реалізації функціональних процесів комерційної діяльності торговельного підприємства як основної складової функції планування і контролю у системі управління. The basis of trade is the purchase and sale of goods due to the change of forms of value. Today, various forms and spheres of activity of commodity markets have been formed, which have different commodity and labor resources, material and technical base. Therefore, the purchase and sale of goods from suppliers, which is based on a commercial basis, not to exhaust the entire variety of commercial activities. Taking into account all types and stages of commercial processes, it is advisable for commercial enterprises to plan their activities carefully, develop a commercial strategy that must be directed to bringing goods to consumers, which is accompanied by commercial actions and operations, the tactic of which is to reduce current costs. The organization of commercial processes and operations is the basis of commercial activity and the level of their management depends on the profitability of a commercial enterprise. The content of the commercial process management is to form an effective system for bringing the product from the manufacturer to the consumer. The main commercial processes include the processes of studying and forming demand for goods, determining the need for goods and services, searching for customers, selecting suppliers, concluding transactions, implementing management measures for the purchase and sale of goods. The commercial activity of the trading company has undergone significant changes. In this regard, it needs to be constantly changed and improved, and in today’s conditions as well. У статті окреслено проблеми організації системи моніторингу ринку туристичних послуг та представлено можливі шляхи їх вирішення. The development of the tourism industry significantly affects the development of the country's economy as a whole. Its role is determined not only in the financial contribution, but also in stimulating other related industries that perform both ancillary and independent functions. The modern Ukrainian tourist market is undergoing many changes, so one of the current problems today is the use of effective tools for finding and systematizing the necessary information to forecast the development of the tourism industry. To increase the growth rate of the tourism industry, the formation of a positive tourist image of the region, increase its visibility requires constant monitoring of the state and development of the tourism market. Monitoring will allow tracking the trends of the tourism market in the dynamics and promptly make changes to the developed programs and plans for the development of the tourism industry, develop recommendations for their adjustment, increase the effectiveness of tourism management.Item
