MARKING OF PYROTECHNIC PRODUCTS AS A MANDATORY REQUIREMENT FOR THEIR SAFE USE(2019) Клименко, А.В.; Klymenko, A.V.; Вяткіна, Л.П.; Viatkina, L.P.According to the Constitution, the human being, his life and health, honor and dignity, inviolability and security are of the highest social value in Ukraine. Consumer rights are among the most important social rights of citizens, whose protection is vested in the State. The consumer at acquisition, the order or use of production in territory of Ukraine has the right to the state protection of the rights, in particular acquisition of production of proper quality safe for a life, health and environment. Pyrotechnic products are classified as hazardous. Products that are classified as hazardous must comply with the requirements of all current technical regulations applicable to such products. Compliance of the recycled, marketed or commissioned pyrotechnic products in Ukraine with the requirements of the Resolution of the Cabinet of Ministers of Ukraine dated August 03, 2011 No. 839 “On Approval of the Technical Regulation of Pyrotechnic Products” (hereinafter referred to as the technical regulation) is mandatory. Information about the pyrotechnic product, instructions for use, safety requirements specified in the product label. Marking is a mandatory requirement for safe use of pyrotechnic products in accordance with the Technical Regulations. The article contains a list of basic requirements that must be specified in the marking of pyrotechnic products, in accordance with the requirements of regulatory documents. A sample marking of fireworks is given.Item Кодифікація майна сил безпеки та оборони України. CODIFICATION OF THE PROPERTY OF THE UKRAINIAN SECURITY AND DEFENSE FORCES(2019) Смерницький, Д.В.; Smernytskyi, D.V.; Кучинський, Ю.Д.; Kuchynskyi, Yu.D.It is noted that the current Ukrainian legislation currently provides for the codification of property (supplies) only for State bodies (military formations) belonging to the Ukrainian defense forces. The purpose of the codification is to improve the efficiency of supply chain management at all stages of the life cycle, to provide the necessary conditions for automated accounting, to improve stockpile management, and to promote the compatibility of the logistics systems of the Ukrainian defense forces with the logistics systems of other countries that use the NATO codification system. The main objective of the codification is to assign a NATO nomenclature number to each item of supply. The NATO Codification System is a logistics nomenclature management tool that fulfills three main objectives of logistics: improving logistics performance, reducing overall costs by preventing the identification of duplicate items, and promoting interoperability. The security forces include law enforcement and intelligence agencies, special- purpose State bodies with law enforcement functions, civil protection forces and other bodies tasked by the Constitution and the laws of Ukraine with ensuring the national security of Ukraine, and the defense forces – the Armed Forces of Ukraine, as well as other military formations, law enforcement and intelligence agencies and special- purpose bodies with law enforcement functions established in accordance with the laws of Ukraine. The analysis of the main regulatory legal acts regulating the procedure of codification of supply items is carried out, as well as the benefits for the sphere of interests of the state and objects of management, which appear during the implementation of the system of codification of supply items of NATO. It has been established that, in order to implement the areas of State national security policy defined by the National Security Strategy of Ukraine, to implement the tasks set out in the National Guard’s Development Concept for the period up to 2020 and other regulatory documents aimed at ensuring effective cooperation between the security and defense forces in the performance of their functions to ensure the defense of the State, it is advisable to extend the scope of the regulatory and legal instruments on the codification of emergencies to the Ukrainian security forces.Item Застосування національних стандартів України для оцінки відповідності феєрверків 1-го,2-го та 3-го класів технічному оегламенту піротехнічних виробів. APPLICATION OF NATIONAL STANDARDS OF UKRAINE FOR ASSESSMENT OF COMPLIANCE OF FIREWORKS OF THE 1ST, 2ND, 3RD, CLASSES WITH THE TECHNICAL REGULATION OF PYROTECHNIC PRODUCTS(2019) Вересенко, Ю.В.; Veresenko, Yu.V.; Романова, Т.В.; Romanova, T.V.Ukraine, as a member of the World Trade Organization, should harmonize its technical regulation system with that of other WTO members. To reform the national technical regulation, new laws of Ukraine were adopted: “On metrology and metrological activity”, “On standardization”, “On technical regulations and conformity assessment”, “On accreditation of conformity assessment bodies”. The European approach to technical regulatory coherence is confirmed by the existence of mutual recognition agreements for conformity assessment results. Conformity assessment in the EU is carried out for compliance with product directives. Product directives define mandatory general (essential) safety requirements. The task of establishing specific characteristics is assigned to European standards, which are voluntary for application. Products manufactured in accordance with the requirements of European standards harmonized with the EU directive are considered to meet the essential requirements of the directive (presumption of conformity principle). European directives are being implemented in Moldova as technical regulations. This normative and legal act, adopted by the public authorities, establishes mandatory requirements for the elimination of the threat to the national security, protection of human life, health and property, protection of animals, plants and environment, etc. Under each approved regulation, the list of national standards ensuring compliance with the requirements of the regulations will be made public. Lists of national standards are formed in accordance with the methodological recommendations approved by the central executive authority, which ensures the formation of state policy in the field of technical regulation. The national standardization body shall, upon request of the relevant central executive authorities, provide them with information and methodological assistance on the formation of lists of national standards. The list of national standards is approved for the first time prior to the entry into force of the relevant technical regulations and is then updated as necessary by approval. In article some disputable questions arising in the course of expert estimations carrying out on marking and tests of fireworks on functioning for carrying out of an estimation of conformity to Technical regulations of pyrotechnic products are considered. Cases when compliance with technical regulations is certified, but certified “today” through the use of a limited list of standards, the voluntary use of which can be perceived as proof of compliance of pyrotechnic products to the requirements of the Technical Regulations of pyrotechnic means.
