Abstract
Метою наукової статті є визначення організаційно-тактичних і психологічних засад проведення слідчих (розшукових) дій з неповнолітніми потерпілими на основі вивчення досвіду іноземних держав та шляхом використання компаративістського методу. Наголошено на доцільності врахування кращого іноземного досвіду правоохоронних органів США та Великої Британії в контексті: розроблення окремої методики допиту неповнолітніх потерпілих з урахуванням їх психологічних особливостей; застосування тактичних прийомів, що відповідають вимогам допустимості; забезпечення сприятливої психологічної атмосфери допиту; забезпечення проведення слідчих (розшукових) дій одним і тим самим слідчим на всіх етапах розслідування, який володіє знаннями з дитячої психології; роз’яснення слідчим з першого допиту неповноліт-нього потерпілого змісту процесу розслідування та завдань кримінального провадження; залучен-ня одного й того самого психолога чи іншої компетентної особи, яка надаватиме безперервно підтримку неповнолітньому потерпілому під час розслідування. The purpose of this paper is to determine the organizational, tactical and psychological prerequisites for investigative (search) actions performance with juvenile victims involved based on the study of foreign practices and with use of
comparative method. Emphasis is placed on importance of best law enforcement practices (USA and Great Britain) to be considered in the context of: developing a special interviewing method for interrogation of juvenile victims based on their psychological profile; use of tactics that does meet the requirements of admissibility; ensuring a favorable psychological environment for the interviewed
subjects; ensuring that investigative (search) actions are taken by the same investigator at all stages of the investigation, with sufficient expertise in the area of juvenile psychology; investigator’s clarification of investigation process and the tasks to be performed while achieving the goals of criminal proceeding presented to the juvenile victim strating from the first interrogation session; continuous involvement of the same psychologist or other competent person able to provide uninterrupted support to juvenile victim during the investigation.
