Abstract
Дисертацію присвячено комплексному дослідженню теоретичних, правових і прикладних проблем участі захисника в кримінальному процесі на стадії досудового розслідування. Окреслено сучасний стан наукового дослідження повноважень цього професійного суб’єкта кримінального процесу; розглянуто права, обов’язки захисника на досудовому розслідуванні, а також гарантії його професійної діяльності. Схарактеризовано повноваження захисника як суб’єкта доказування щодо витребування та отримання речей і документів на досудовому розслідуванні, під час проведення слідчих (розшукових) дій та в межах здійснення міжнародного співробітництва. Визначено зміст повноважень захисника під час застосування заходів забезпечення кримінального провадження на досудовому розслідуванні, зі спростування підозри, на етапі закінчення досудового розслідування, а також у процесі здійснення особливих порядків кримінального провадження на досудовому розслідуванні. The dissertation is devoted to the complex research of theoretical, legal and applied problems of the Defense Counsel participation in criminal process at the stage of pre-trial investigation. The current state of scientific research of the powers of this professional subject of criminal proceedings is outlined; the rights, responsibilities of the defense counsel during pre-trial investigation, as well as guarantees of his professional activity, are considered. The powers of the defense counsel as a subject of investigation to request and receive evidences and documents during the pre-trial investigation, during the investigative (search) activities and in the framework of international cooperation are described. The content of the defense counsel powers during the application of measures to ensure criminal proceedings in the pre-trial investigation; to refute the suspicion, at the end of the pre-trial investigation; during the implementation of special procedures of criminal proceedings during the pre-trial investigation are defined.
