Abstract
У науковій статті визначено юридичну природу та досліджено процесуальний порядок укладення мирової угоди як однієї з процесуальних форм примирення сторін у цивільному процесі. Визначено, що мирова угода сторін – це правочин, укладений між сторонами з метою врегулювання спору на основі взаємних поступок, який може стосуватися лише прав та обов’язків сторін і предмета позову. Особливість мирової угоди полягає у тому, що вона замінює спірні правовідносини (права та обов’язки) сторін безспірними, чітко визначеними. Це, з одного боку, свідчить про ліквідацію допроцесуального правовідношення, а з іншого – про виникнення нового правовідношення. The scientific article defines the legal nature and examines the procedural procedure for concluding an amicable agreement as one of the procedural forms of conciliation of the parties in civil proceedings. It is determined that an amicable agreement between the parties is a transaction concluded between the parties for the purpose of resolving a dispute on the basis of mutual concessions, which may concern only the rights and obligations of the parties and the subject of the claim. The peculiarity of the amicable agreement is that it replaces the disputed legal relationship (rights and obligations) of the parties with indisputable, clearly defined. This, on the one hand, indicates the liquidation of the pre-trial relationship, and on the other – the emergence of a new relationship.
