Abstract
У статті аналізується кримінально-правовий зміст поняття «спеціальна осудність» у контексті тлумачення ознак спеціальних суб’єктів кримінальних правопорушень проти безпеки виробництва, передбачених розділом Х Особливої частини Кримінального кодексу України. «Спеціальна» осудність розглядається як здатність особи до адекватної розумної поведінки в умовах нервово-психічних перевантажень; здатність особи усвідомлювати характер і значення своїх дій і керувати ними пов’язується не лише з медичними ознаками, а й з іншими соціальними обставинами з урахуванням додаткових професійних чи службових обов’язків. The article analyzes criminal-legal content of the concept “special sanity” in the context of interpretation of features of special subjects of criminal offences against safety of production stipulated by Section Х of the Special Part of the Criminal Code of Ukraine. “Special” sanity is considered as capacity of the person to adequate, reasonable behaviour under the conditions of neuropsychic overload; the person’s ability to understand the character and meaning of his/her actions and to control them is related not only to medical features, but also to other social circumstances, taking into account additional professional or official duties.
