Item СТАТИСТИЧНИЙ АНАЛІЗ ДЕРЖАВНОГО БОРГУ УКРАЇНИ У СУЧАСНИХ ЕКОНОМІЧНИХ УМОВАХ. Розкрито сутність державного боргу, гарантованого державою боргу, зовнішнього та внутрішнього боргу та зміст відносної величини боргу. На основі статистичних даних Міністерства фінансів України та Державної служби статистики України досліджено динаміку сукупного боргу України та здійснено аналіз його структуру за типом боргового зобов’язання й за типом кредитора. Визначено вплив зовнішніх запозичень на економічне зростання шляхом обчислення та аналізу відносної величини боргу – питомої ваги державного та гарантованого державою боргу в обсягах валового внутрішнього продукту, доходів державного бюджету та доходів населення. The public debt at the present stage is an objective economic phenomenon, a component of the financial system and a tool for implementing the economic strategy of the country, and its effective use can be a powerful factor in its economic growth. The paper is devoted to the study the economic essence, current state, structure and main trends of the total public debt of Ukraine. Essence of national debt, state-guaranteed debt, foreign and domestic debt and maintenance of relative amount and rate of debt are exposed. Under the type of debt obligation, public debt is divided into direct (unconditional) and guaranteed (conditional) debt, which arises as a result of the state's obligations to third parties or guarantees for these obligations. There is also a division of public debt by type of creditor. Domestic and foreign public debt are distinguished on this basis. Based on statistical data of Ministry of finance of Ukraine and Government service of statistics of Ukraine the dynamics of the debt of Ukraine is analyzed and an analysis of its structure according the type of debt obligation, and the type of creditor is carried out.Item ЗАПОБІГАННЯ ТА ВРЕГУЛЮВАННЯ КОНФЛІКТУ ІНТЕРЕСІВ У ПУБЛІЧНІЙ СЛУЖБІ: УКРАЇНСЬКІ РЕАЛІЇ ТА ЗАРУБІЖНИЙ ДОСВІД. PREVENTION AND SETTLEMENT OF CONFLICT OF INTERESTS IN PUBLIC SERVICE: UKRAINIAN REALITIES AND FOREIGN EXPERIENCE(2021) КАЛАШНИК, Дар’я Володимирівна; KALASHNYK, Dariia; МОСКАЛЕНКО, Анастасія Олексіївна; MOSKALENKO, AnastasiiaУ статті проаналізовано визначення поняття «конфлікт інтересів». Сформовано системний диференційований підхід до тлумачення явища конфлікту інтересів у професійній діяльності публічних службовців. Наголошено на проблемності цього явища. Проаналізовано чинне вітчизняне законодавство, покликане регламентувати процес запобігання та врегулювання конфлікту інтересів. Досліджено зарубіжний досвід правового регулювання конфлікту інтересів, сформульовано концептуальні підходи з удосконалення запобігання та врегулювання конфлікту інтересів у публічно-правових відносинах засобами адміністративного права. The paper analyzes the definition of the concept of “conflict of interests”. A systematic, differentiated approach to the interpretation of the phenomenon of conflict of interests in the professional activity of public servants was formulated. The structure and types of conflict of interest are determined. Conflict of interest is defined as the presence of a private interest of a public official, which may or does affect the objectivity or impartiality of decision-making or the commission or failure to act, in the exercise of his official, representative or other public authority. The problem character of this phenomenon is noted. The analyzes of existing domestic legislation designed to regulate the process of prevention and settlement of the conflict of interest. This paper describes the phenomenon of corruption, its impact on the system of government; investigated a conflict of interest in public service as a kind of malfeasance. The paper stressed that the conflict of interest is a corruption risk in the work of the public servants. The paper noted the importance of creating an effective system to prevent corruption. Corruption is a significant problem in modern Ukraine, which significantly impedes the development of Ukraine as a democratic, legal and social state, impinges on the rule of law, and slows down the development of the economy. Therefore, effective prevention of corruption is an important task for the authorized bodies of public authority of Ukraine. The legislation includes the person’s plan of action in case of the conflict of interest. A comparative analysis of foreign experience in legal regulation of conflicts of interest, conceptual approaches are formulated of prevention and settlement of the conflict of interests in public-law relations by means of administrative law are given. In order to improve mechanisms for prevention and settlement of conflict of interest on the basis of international experience suggested, certain mechanisms aimed at preventing conflicts of interest.Item МОДЕЛІ ПРОГНОЗУВАННЯ РІВНЯ БОРГОВОЇ БЕЗПЕКИ УКРАЇНИ. DEBT SECURITY FORECASTING MODELS(2021) КОНДРО, Павло Володимирович; KONDRO, PavloУ статті проведено дослідження моделей прогнозування боргової безпеки України. Основною метою статті є розкриття теоретико-практичної складової прогнозування боргової безпеки різних типів прогноз-моделей, за допомогою яких можна здійснювати боргове прогнозування. У процесі дослідження акцентовано увагу на борговому прогнозуванні як факторі мінімізації фінансово-боргових шоків. Наведено трактування дефініції боргова безпека. Здійснено порівняльну характеристику досліджуваних моделей зі співставленням отриманих результатів інтегрального показника боргової безпеки. Виділено пріоритетні напрями майбутніх досліджень. The paper examines models for predicting Ukraine's debt security. The main purpose of the paper is to reveal the theoretical and practical component of debt security forecasting of various types of forecast models that can be used to predict debt parameters. In the course of the study, attention is focused on debt forecasting as a factor in minimizing financial and debt shocks. The interpretation of the definition of debt security in a broad and narrow sense is given. The linear trend model of forecasting debt indicators is studied and it is concluded that it acts as a fundamental element in the process of debt forecasting, but cannot guarantee high quality planning of future indicators. A study was also conducted in the context of medium-term forecasting using ARIMA and multivariate regression models, which showed satisfactory qualitative characteristics in the process of simulating future debt security parameters. Forecasting of financial and debt parameters using ARIMA models, in the context of econometric and statistical quality, showed a sufficient level of adequacy of regression equations. The ARIMA model for simulating future values of debt parameters is characterized by an approximate value of the integral debt security indicator to the regulatory level. Based on the obtained models, a comparative characteristic of the studied models is carried out with a comparison of the obtained results of the integral debt security indicator and calculation of the absolute financial strength margin indicator based on them. Based on the results of the study, it can be concluded that the use of ARIMA models and multiple regressions is the optimal method for predicting debt with a high level of adequacy of the simulated values and rather low labor costs in the procedural context. Встановлено, що основною формою фінансового забезпечення освітніх послуг в Україні є бюджетне фінансування, а основним джерелом – бюджетні ресурси. Розгляд бюджетного фінансування освітніх послуг крізь призму законів та категорій діалектики дав змогу сформувати науково-методологічний підхід до його визначення як сутність, явище, зміст, форма. Охарактеризовано та проаналізовано вітчизняну практику фінансування освітніх послуг із Державного й місцевих бюджетів України. Виявлено основні проблеми бюджетного фінансування освітніх послуг та розроблено рекомендації відносно його покращення. High-quality educational services play a key role in shaping the intellectual potential of the population, increasing the level of social well-being and ensuring inclusive sustainable development of the state. A prerequisite for the provision of highquality and affordable public educational services is the proper level of their funding at the expense of various sources. The need to solve problems related to the budget financing of education, due to the limited volume and inefficient use of available financial resources, requires the development of new approaches to the organization of financing of educational services. The most justified is the definition of «educational service» as an intangible benefit, which is aimed at forming competences for the future professional and / or further educational activities. Educational services can be classified according to such criteria as the source of funding, forms, components and levels of education, ownership form and organizational and legal status of the educational entity. Review of budget financing of educational services through the prism of laws and categories of dialectics made it possible to form a scientific and methodological approach to its definition as an essence, phenomenon, content, form. Important ways to improve the budget financing of educational services are the optimization of the network and the costs of educational service providers of various levels; more efficient use of available funds; intensification of such forms of public participation at the level of territorial communities, regions as a public budget in the formation of budget resources for their further allocation to improve the conditions for the provision of educational services; formation of an offer of educational services for which budgetary resources are spent, providers, especially in the field of vocational and higher education, according to the results of monitoring the demand for graduates of certain specialties in the labor market; allocation of budgetary resources between budget programs in the field of providing educational services, taking into account gender aspects; strengthening control over the effective use of budgetary resources aimed at providing educational services.Item THE ROLE OF CREDIT RESOURCES IN FINANCIAL SUPPORT OF AGRICULTURAL MANUFACTURERS IN MODERN ECONOMIC CONDITIONS. Using the analysis of commercial banks, the role of bank lending as an important source of financial support for the functioning of agricultural enterprises is revealed. The analysis of the loan portfolio of agricultural enterprises is carried out with the definition of the dominant feature – the Program of reduction of credit resources due to the introduction of new credit programs.It is outlined that the access of agricultural enterprises to credit resources gives them the opportunity to master the innovative technologies needed to ensure the appropriate level of their competitiveness. The actual offers of credit products for financing the development of agriculture in Ukraine through the tools of preferential lending, specialized banking programs are described. Emphasis is placed on the problems that hinder the development of the agricultural sector, the state of lending to agricultural producers, the regulation of lending to agricultural enterprises. The current state of loans by banking institutions to the agroindustrial complex, stimulation of its development by the state are analyzed and researched, special emphasis is placed on modern programs of credit products, their positioning in line with traditional forms of credit. It is substantiated and proved that credit support for the functioning of agricultural producers in the modern economicenvironment is aimed at developing a system of interaction with the agricultural sector of the economy, which is an important factorin economic growth, improving the economic situation in a competitive environment. Suggestions and recommendations for more effective financing of the agricultural sector of Ukraine in modern economic conditions are provided. У статті досліджено питання актуальності кредитування аграрного сектора як зовнішнього джерела фінансування сільськогосподарських виробників. Вдаючись до аналізу діяльності комерційних банків, розкрито роль банківського кредитування як важливого джерела фінансового забезпечення функціонування сільськогосподарських підприємств. Здійснено аналіз кредитного портфеля аграріїв із визначенням домінантної риси – Програми здешевлення кредитних ресурсів завдяки впровадженням нових кредитних програм. Окреслено, що доступ сільськогосподарських підприємств до кредитних ресурсів надає їм можливість освоєння інноваційних технологій, необхідних для забезпечення належного рівня їхньої конкурентоспроможності. Охарактеризовано актуальні пропозиції кредитних продуктів для фінансування розвитку сільського господарства в Україні через інструменти пільгового кредитування, спеціалізовані банківські програми. Акцентовано на проблеми, що гальмують розвиток аграрного сектору стан кредитування сільськогосподарських виробників, регулювання кредитування сільськогосподарських підприємств. Проаналізовано й досліджено поточний стан позик банківськими установами агропромисловому комплексу, стимулювання його розвитку з боку держави, особливо акцентовано на сучасні програми надання кредитних продуктів, їх позиціонування поряд з традиційними формами надання кредиту. Обґрунтовано й доведено, що кредитне забезпечення функціонування сільськогосподарських виробників в умовах сучасного економічного середовища спрямоване на розвиток системи взаємодії з аграрним сектором економіки, що є вагомим чинником економічного зростання, поліпшення економічної ситуації в конкурентоспроможному середовищі. MATHEMATICAL MODELING OF INFLUENCE OF STAKEHOLDER INDICATORS ON DEVELOPMENT OF CONSTRUCTION ENTERPRISES(2021) ВЕЛИЧКО, Володимир Анатолійович; VELYCHKO, VolodymyrВстановлено, що на сучасному етапі економічних перетворень потребують переосмислення підходи до функціонування будівельних підприємств як важливих суб’єктів господарювання, що впливають на розвиток інших сфер та держави загалом. Визначено, що актуальним питанням є формування кількісної основи прийняття обґрунтованих управлінських рішень на основі економіко-математичного моделювання впливу стейкхолдерних показників на розвиток будівельних підприємств. У роботі вирішено завдання: визначення стейкхолдерних чинників, що впливають на функціонування будівельних підприємств; оцінювання інтегрального показника рівня стейкхолдерних відносин будівельних підприємств; визначення показника розвитку будівельних підприємств; характеристика напрямів економіко-математичного моделювання впливу рівня стейкхолдерних відносин на показник розвитку будівельних підприємств; встановлення причинно-наслідкових зв’язків між показниками рівня стейкхолдерних відносин і розвитку будівельних підприємств; розроблення заходів зростання ефективності стейкхолдерних відносин для забезпечення розвитку будівельних підприємств. It is established that at the present stage of economic transformations the approaches for the construction enterprises functioning as important economic entities that affect the development of other spheres and the state in general need to be reconsidered. It is determined that the actual issue is creating the quantitative basis for making reasonable management decisions based on economic and mathematical modeling of the impact of stakeholder indicators on the development of construction companies. The issues aresolved: determination of stakeholder factors that influence on construction enterprises functioning; assessment of the integral indicator of the level of stakeholder relations of construction companies; determination of the indicator of development of construction enterprises; characteristics of economic and mathematical modeling directions of influence of stakeholder relations level on the indicator of development of construction enterprises; establishing the causal links between indicators of the level of stakeholder relations and the development of construction companies; development of measures for increasing the stakeholder relations effectiveness to ensure the development of construction companies.Item ПРАВОВИЙ МЕХАНІЗМ ДОТРИМАННЯ ПРОЦЕСУАЛЬНИХ СТРОКІВ У ЦЕЛЕРАНТНИХ СПРАВАХ У АДМІНІСТРАТИВНОМУ СУДОЧИНСТВІ УКРАЇНИ. LEGAL MECHANISM OF OBSERVANCE WITH PROCEDURAL TERMS IN CELERANT CASES IN ADMINISTRATIVE PROCEEDINGS OF UKRAINE(2021) БОРИСЕВИЧ, Михайло Олегович; BORYSEVYCH, MykhailoДосліджено особливості процесуальних строків у целерантній (спрощеній, пришвидшеній) моделі розгляду адміністративної справи. Проаналізовано ключові причини систематичності порушення адміністративними судами процесуальних строків. Визначено окремі шляхи вирішення проблем дотримання проблеми недотримання адміністративними судами процесуальних строків у адміністративних справах, що розглядаються за правилами спрощеного позовного провадження (целерантних справах). Запропоновано введення категорії пріоритетних адміністративних справ, що розглядаються, з метою вдосконалення механізму дотримання процесуальних строків у целерантних (спрощених) справах у адміністративному судочинстві України. Запропоновано способи ефективного призначення засідань у пріоритетних справах, строк розгляду яких закінчується. Observance with both general and reduced (celerant) procedural terms is a significant problem in the national judicial system, and in the system of administrative justice in particular. The practice of considering administrative cases beyond the established term is extremely common, which violates the right to a fair and timely trial. Some special attention to the issues of terms of consideration of administrative cases was paid by M. Arakelian, Ya. Bernaziuk, P. Huivan, O. Nehara, L. Tatsii and others. However, the study of the mechanism for ensuring of observance with procedural terms for the consideration of celerant administrative cases is still little studied and requires further research. According to the author, the ways to solve of problem of non-observance with procedural terms are to solve the issue of “staff shortage” of the judicial system of Ukraine, increase the responsibility of judges for violating procedural terms, introduce the concept of priority cases, which expire and introduce an effective way to schedule meetings in such cases. In addition, there is a need to further develop the issue of optimizing the procedure of celerant cases in order to bring them to the standard “one case – one meeting”.Item
