    Стаття присвячена аналізу порядку реалізації права особи на звернення до господарського суду із заявою про відкриття провадження у справі про банкрутство юридичної особи. Досліджуються особливості відкриття провадження у таких справах згідно з нормами Кодексу України з процедур банкрутства. Наголошується, що з моменту прийняття цього Кодексу українське законодавство у даній сфері стало більш уніфікованим по відношенню до європейського законодавства і, водночас, відповідає тій ситуації, що склалася в Україні на даному етапі реформування і розвитку національної економіки. The article is devoted to the analysis of the procedure for exercising the right of a person to apply to the commercial court with a statement on the opening of proceedings in the case of bankruptcy of a legal entity. Peculiarities of initiating proceedings in such cases in accordance with the norms of the Bankruptcy Procedure Code of Ukraine are investigated. It is noted that since the adoption of this Code, Ukrainian legislation in this area has become more unified in relation to European legislation and, at the same time, corresponds to the situation in Ukraine at this stage of reforming and developing the national economy.
