Abstract
У статті проаналізованозначення та роль визначної історичної пам’ятки українського державотворення першої половини XVIII ст. –Конституції Пилипа Орлика в контексті європейської правотворчості. Розглянуто її як важливий політико-правовий документ, щомістить такі елементи доктрини природного права, як: справедливість, гуманізм, повага до прав і свобод людини, рівність перед законом, поділ влади. Метоюдослідження є застосування філософсько-правової рефлексії до з’ясування ролі Конституції Пилипа Орлика в розвитку та формуванні українського та європейського права. The article analyzes the significance and role of the outstanding historical monument of the Ukrainian state formation of the first half XVIII century PylypOrlyk’s Constitution in the context of European lawmaking. It is considered as an outstanding political and legal document, which contains such elements of the doctrine of natural law as justice, humanism, respect for human rights and freedoms, equality before the law, separation of powers. The purposeis to apply philosophical and legal reflection to clarify the role of the Constitution of PylypOrlyk in the development and formation of domestic and European law.
