| dc.description.abstract | У статті проаналізовано особливості призначення і проведення судової експертизи в межах діяльності Європейського суду з прав людини. Європейський суд з прав людини вперше в історії європейського та міжнародного права застосував норми про права людини та основоположні свободи до оцінки практики призначення і проведення судових експертиз. Так, виходячи із аналізу рішень ЄСПЛ, питання судової експертизи виникали в його діяльності при вирішенні скарг на несправедливий судовий розгляд, відсутність ефективного розслідування, порушення права на повагу до приватного життя, застосування тортур, нелюдського або такого, що принижує людську гідність поводження та покарання. The article analyzes the peculiarities of the appointment and conducting of forensic examination within the activities of the European Court of Human Rights. For the first time in the history of European and international law, the European Court of Human Rights has applied human rights and fundamental freedoms to evaluate the practice of purpose and conducting forensic examinations. Thus, based on the analysis of ECHR decisions, issues of forensic science arose in its activities in resolving complaints of unfair trials, lack of effective investigation, violation of the right to respect for private life, torture, inhuman or degrading treatment or punishment. | |
