| dc.description.abstract | У статті здійснюється аналіз доктринальних положень, позицій правників і судової практики стосовно вирішення питання щодо розмежування адміністративної та цивільної юрисдикцій. Виділено проблемні аспекти визначення підвідомчості земельних спорів. Досліджена проблема недостатнього розмежування підвідомчості земельних спорів. Наведено різні підходи та приклади судової практики щодо визначення підсудності земельних спорів, що змінювались протягом часу. Установлено, що вирішення земельного спору в судах практично водночас формується та регулюється нормами Цивільного процесуального кодексу, Господарського процесуального кодексу та Кодексу адміністративного судочинства України. The article analyzes the doctrinal positions, the positions of lawyers and jurisprudence on the issue of the delineation of administrative and civil jurisdiction. The problematic aspects of determining the jurisdiction of land disputes are highlighted. The problem of insufficient delimitation of jurisdiction over land disputes is investigated. Different approaches and views of jurisprudence concerning the definition of the jurisdiction of land disputes that have changed over time are given. It has been established that the resolution of land disputes in courts is practically simultaneously formed and regulated by the norms of the Civil Procedural Code, the Commercial Procedural Code and the Code of Administrative Justice of Ukraine. | |
