| dc.description.abstract | У статті здійснено історіографічний аналіз наукового доробку правознавців, присвяченого дослідженню законодавчих засад організації, становлення й подальшої діяльності вищих органів державної влади за доби Української Центральної Ради (УЦР). Звернено увагу, що законотворча діяльність Центральної Ради розпочалася ще до проголошення Української Народної Республіки (УНР) і мала спочатку переважно політико-декларативний характер. Наголошується, що сучасні науковці схиляються до думки, що спочатку Центральна Рада виконувала функції тимчасового українського уряду й фактично зосередила функції й законодавчої, і виконавчої влади, але, на їхню думку, на жодному етапі своєї діяльності УЦР не відповідала всім критеріям парламенту в його класичному розумінні й називають її «передпарламентом». The article presents a historiographical analysis of the scientific achievements of the lawyers, devoted to the study of the legislative foundations of the organization, formation and further activities of higher state authorities during the Ukrainian Central Council/Rada (UCC). It is noted that the legislative activity of the Central Rada began before the proclamation of the Ukrainian People’s Republic (UPR) and was initially mainly political and declarative in its nature. It is noted that modern scholars are inclined to believe that the Central Rada originally served as the interim Ukrainian government and, in fact, concentrated the functions of both the legislature and the executive bodies, but, in their opinion, at no stage of its activities Ukrainian Central Council/Rada met all the criteria of parliament in its classical sense and was often called “pre-parliament”. | |
