Abstract
У статті здійснено аналіз відповідності розділу VIII «Злочини проти довкілля» Особливої частини КК України, у тому числі положень ст. 239-2 КК України приписам Конституції України. Проведено розмежування досліджуваного складу злочину від суміжних злочинних посягань. Доводиться відповідність положень ст. 239-2 КК України положенням Основного закону України, а також її унікальність у сфері кримінально-правової охорони прав громадян, що гарантовані Конституцією України. The article analyzes the compliance of section VIII "Crimes against the environment" Special part of the Criminal Code of Ukraine, including the provisions of Art. 239-2 of the Criminal Code of Ukraine prescriptions of the Constitution of Ukraine. A distinction was made between the investigated crime and related criminal offenses. There is compliance with the provisions of Art. 239-2 of the Criminal Code of Ukraine by the provisions of the Basic Law of Ukraine, as well as its uniqueness in the field of criminal law protection of the rights of citizens, guaranteed by the Constitution of Ukraine.
