| dc.description.abstract | У статті розглядаються форми та способи захисту прав суб’єктів фінансових правовідносин, наведено їх класифікацію. Виокремлено заходи превентивного характеру, спрямовані на убезпечення суб’єкта правовідносин від порушення його прав, та способи, пов’язані з відновленням порушеного права. Основна увага приділяється розкриттю останніх із названих способів. В межах цієї групи досліджено позасудову та судову форми захисту. Зазначено, що вибір форми та способу захисту залежать від виду суб’єкта, який звертається за захистом порушеного права, та від виду фінансових правовідносин (податкові, бюджетні тощо), в межах яких порушено те чи інше право. Усі існуючі форми чітко виписані в чинному законодавстві. The article examines the forms and methods of protection of rights of subjects of financial legal relations and provides their classification. The author distinguishes preventive measures aimed at protecting a subject of legal relations from violation of its rights and methods related to restoration of the violated right. The main focus is on the latter of these methods. Within this group, the author examines the out-of- court and court forms of protection. It is noted that the choice of the form and method of protection depends on the type of entity seeking protection of the violated right and on the type of financial relations (tax, budget, etc.) within which a particular right is violated. All existing forms are clearly set out in the current legislation. | |
