Abstract
Статтю присвячено висвітленню проблемних питань підтримання прокурором державного обвинувачення в суді та забезпечення прав особи під час виконання цієї функції. Проаналізовано чинне кримінальне процесуальне законодавство, що регулює виконання цієї функції прокурором, і зроблено висновок, що прокурор забезпечує захист прав особи в трьох рівнях: перший – захист природних прав особи; другий – захист конституційних прав особи; третій – забезпечує використання процесуальних прав особи. The article is devoted to covering the problematic issues of the prosecutor's support of the state prosecution in court and ensuring the rights of the individual while performing this function. The current criminal procedural legislation regulating the performance of this function by the prosecutor is analyzed and the conclusion is drawn that the prosecutor provides protection of the rights of the person at three levels: the first is the protection of the natural rights of the person; the second is the protection of the person's constitutional rights; third – ensures the use of procedural rights of the person.
