| dc.description.abstract | Стаття присвячена висвітленню питань особливостей складного (комплексного) розуміння причинності та його втілення у сфері кримінальної відповідальності юридичних осіб. За методологічну основу наукової розробки беруться, з одного боку, метод складності Е. Морена, відповідно до якого причинність позбавляється свого класичного розуміння у ключі лінійності. Складна причинність описується як рекурсивна та така, що генерує себе ж. Вона розкривається через призму двох рівнів причинно-наслідкової валентності – екзо- та ендо-рівнів, а також їх взаємодії у рамках конструкту комплексної відносної причинності. З іншого боку, застосовується метод індикації Дж. Спенсера-Брауна, за допомогою якого конструюється матриця складної причинності як цілісна одиниця (монада). Опис такої монади у комунікативному аспекті розкриває її відносну самодостатність або, іншими словами, аутопоезис самої відповідальності. The article is devoted to the issues of composite (complex) causality understanding peculiarities and its implementation in the field of legal entities criminal liability. The methodological basis of scientific development is taken, on the one hand, the E. Moran’s method of complexity, according to which causality loses its classical understanding in the key of linearity. Composite causality is described as recursive and self-generating. It is revealed through the prism of two causal valence levels – exo- and endo-levels, and their interaction within the construct of complex relative causality. On the other hand, the J. Spencer-Brown indication method is used, by means of which a complex causality matrix is constructed as an integral unit (monad). The description of such monad in the communicative aspect reveals its relative selfsufficiency or, in other words, the autopoiesis of responsibility itself. | |
