Abstract
У статті проаналізовано правовий статус прокурора у виконавчому провадженні на підставі положень основних нормативно-правових актів, які регулюють правовий статус прокуратури загалом та виконавчого провадження. У виконавчому провадженні прокурор здійснює представницьку функцію – представляє інтереси держави, громадянина, за умови, що ним здійснювалось представництво інтересів цих суб’єктів у суді. У науковій статті акцентується, що представництво інтересів у суді відповідних суб’єктів та представництво інтересів цих суб’єктів у виконавчому провадженні є різними видами представництва, які до того ж не є законодавчо взаємообумовленими. У науковій статті звернута увага на деякі законодавчі неузгодженості щодо правового регулювання правового статусу прокурора у виконавчому провадженні. The legal status of prosecutor is analyzed in the article, grounding on prescriptions of basic legislative acts, that regulate the legal status of prosecutors’ office generally and executive process. In executive process prosecutor provide representative function – represent public interests, interests of person, by the cause that the prosecutor has already represented theirs interests during lawsuits. In the scientific article is accented that representation the interests of corresponding subjects during lawsuits and representation the interests of this subjects in executive process are two different kinds of representation that, additionally telling, are out of interdependent. In the scientific article, the attention is put on some legislative collisions, connected to legislative regulation in the sphere of legal status of prosecutor in executive process.
