| dc.description.abstract | У статті йде мова про судову правотворчість в цивільному судочинстві України, яка має місце з підстав наявності в матеріальному праві певних законодавчих прогалин. Автори звертають увагу на те, що законодавчі прогалини у вигляді неповноти, неточності чи суперечливості норм права являють собою природну закономірність, яка завжди має місце там, де цивільні відносини набувають свого динамічного розвитку і законодавець виходячи із об’єктивності законодавчих актів, які одночасно діють в часі і просторі нашої держави об’єктивно не встигає контролювати відповідність всіх норм права рівню суспільного розвитку. The article deals with judicial law-making in the civil judiciary of Ukraine, which takes place due to the existence of certain legislative gaps in the substantive law. The authors draw attention to the fact that legislative gaps in the form of incompleteness, inaccuracy or inconsistency of legal norms are a natural pattern that always occurs where civil relations acquire their dynamic development and the legislator based on the objectivity of legislative acts that simultaneously act in the time and space of our country does not have time to objectively monitor the compliance of all legal norms with the level of social development. | |
