Abstract
У статті досліджено теоретичні аспекти легітимноcті права в конструкції правової держави. Визначено, що ідея легітимності права проходить червоною ниткою через всю історію світової правової думки, починаючи з часів Великої хартії Вольностей і до наших днів. Зазначено, що явище легітимності пов’язується з середини XX століття з розвиненими громадянськими і демократичними інститутами. The article examines the theoretical aspects of the legitimacy of law in the construction of a state governed by the rule of law. It is determined that the idea of the legitimacy of law runs through the entire history of World legal thought, from the time of Magna Carta to the present day. It is noted that the phenomenon of legitimacy has been associated since the middle of the XX century with developed civil and democratic institutions.
