Abstract
Стаття присвячена аналізу сутності меж розсуду в правовій доктрині загалом і кримінальному процесі зокрема. У статті автор досліджує погляди різних науковців щодо встановлення меж розсуду, робить висновок, що межі розсуду в кримінальному процесі можна визначити як обмеження повноважень суб’єктів кримінального процесу під час застосування розсуду, у разі порушення яких не виконуються основні завдання розсуду, а сам розсуд може бути визнаний незаконним. У подальшому автор аналізує доктринальні класифікації меж розсуду, у результаті чого, з огляду на запропоноване автором визначення, зроблено висновок, що здійснити класифікації меж розсуду в кримінальному процесі неможливо. This article is devoted to the analysis of discretion boundaries in the legal doctrine as a whole and in the criminal process in particular. In the article author examines views of different scholars on establishing boundaries of discretion, and concludes that such boundaries of discretion in criminal proceedings can be defined as a restriction of powers of criminal proceedings subjects in the application of discretion, violation of which may cause the failure of discretion tasks or discretion itself could be declared illegal. Subsequently, author analyses doctrinal classifications of discretion boundaries, and as a result, it was concluded that it is impossible to classify such boundaries of discretion in criminal proceedings. The main point of such conclusion lies within the understanding the discretion boundaries, because discretion in criminal proceedings is a set of certain powers of criminal procedural authorities. Accordingly, limits of discretion are defined as limitation of such powers.
