Abstract
Статтю присвячено проблемі закріплення психічного насильства у вітчизняному законодавстві. Висвітлення теми психічного впливу, розкриття сутності та виявлення мети застосування важливі, адже сьогодення характеризується дедалі частішою практикою застосування саме психічного насильства. Досліджено проблеми психічного насильства в теорії кримінального права України. Визначено ознаки психічного насильства, досліджено ознаки суб’єктивної сторони. Дається загальна характеристика змісту психічного насильства. Насильство, від якого потерпають постраждалі, має вплив на різні аспекти їхнього життя, насамперед на стан психічного здоров’я, а отже, вони потребують законодавчо закріплених гарантій своєї безпеки. Розглянуто думки вчених, котрі займалися вивченням цієї теми. Акцентується увага на основних ознаках поняття насильства, що мають значення для кримінально-правової оцінки діянь. Досліджено особливості насильницьких злочинних дій із застосуванням психічного впливу. Зроблено висновок, що вплив на психіку людини з метою заподіяти шкоду її життю, здоров’ю, свободі чи майну, який спричинив чи міг спричинити таку шкоду, потрібно називати психічним насильством. The article is devoted to the problem of consolidation of mental violence in the domestic legislation. Illumination of the topic of mental influence, the disclosure of the essence and the purpose of the application is very important today, because today is characterized by an increasingly frequent practice of the use of just psychological violence. The problems of mental violence in the theory of criminal law of Ukraine are investigated. The signs of mental violence are identified, thus the features of the subjective side are investigated. General description of determination of concept, maintenance, of psychical violence is given. A general description of the content of mental violence is given. The violence suffered by the victim has an impact on various aspects of their lives, and above all affects the state of mental health, and, consequently, it means that they need legally guaranteed security assurances. Opinions of scientists of criminal lawyers which was engaged in the study of this theme are considered. Attention is focused on the main features of the concept of violence that are important for the correct legal assessment of the criminal acts. The features of violent criminal actions with the use of mental influence are investigated. It is concluded that the impact on the human psyche in order to cause damage to its life, health, freedom or property, which caused or could cause such harm, should be called psychic violence.
