Abstract
З науково-практичної точки зору розкрито зміст понять «медіація», «теоретична модель медіації». На підставі науково-практичного аналізу запропоновано автор- ський погляд на складові процесу медіації. Процес медіації (процесуально-орга- нізаційна модель медіації чи теоретична модель медіації) складається із декількох послідовних стадій, визначених Законом України «Про медіацію» (ст. 16 та ст. 17 Закону), кожна з яких містить декілька етапів, на яких вчиняються процесуальні дії. Пропонуємо виділяти три стадії процесу медіації: 1) підготовчу стадію; 2) безпосе- редню процедуру медіації; 3) завершення процедури медіації – укладання угоди за результатами медіації та її виконання. From a scientific and practical point of view, the meaning of the concepts “mediation”, “theoretical model of mediation” is revealed. On the basis of scientific and practical analysis, the author’s view on the components of the mediation process is proposed. The mediation process (procedural-organizational model of mediation or theoretical model of mediation) consists of several successive stages defined by the Law of Ukraine “On Mediation” (Articles 16 and 17 of the Law), each of which contains several stages at which procedural actions are taken. We propose to distinguish three stages of the mediation process: 1) preparatory stage; 2) direct mediation procedure; 3) completion of the mediation procedure – conclusion of an agreement based on the results of the mediation and its implementation.
