| dc.description.abstract | У статті аналізується правова основа місцевого самоврядування у Французькій Республіці. До правової основи місцевого самоврядування сучасної Франції можна віднести Конституцію Франції, законодавчі та регламентарні (урядові) акти, які кодифіковані в єдиний акт – Загальний кодекс територіальних колективів 1996 року, міжнародні джерела, передусім Європейську хартію місцевого самоврядування 1985 року, а також судові рішення. Кодифікація сприяє спрощенню доступу до закону у Франції, зокрема, зменшуючи кількість попередньо розпорошених законів і декретів, які збираються в єдиному довідковому документі та переробляються відповідно до плану, що полегшує розуміння правил. Унікальність кодексу пов’язана з тим, що вона об’єднує закони, декрети уряду. Суддівське право має досить велике значення, зокрема, з огляду на принцип загальної компетенції територіальних колективів. The article analyzes the legal basis of local self-government in the French Republic. The legal basis of local self-government in modern France include the Constitution of France, legislative and regulatory (government) acts, which are codified into a single act – the General Code of Territorial Collectives 1996, international sources, especially the European Charter of Local Self-Government in 1985, as well as Codification helps to facilitate access to the law in France, in particular by reducing the number of previously scattered laws and decrees that are compiled in a single reference document and revised according to a plan that facilitates understanding of the rules. The uniqueness of the code is due to the fact that it unites laws, decrees of the government. Judicial law is of considerable importance, including in view of the principle of the general competence of territorial teams. The author refers to local sources by acts of local referendums, acts of bodies and officials of local self-government, as well as agreements on the delegation of powers, in particular, to bodies of inter-municipal cooperation. | |
