| dc.description.abstract | У статті розглянуто окремі аспекти впровадження інституту медіації в Україні. Зазначається, що медіація як новий і невластивий для України правовий інститут поки не набула поширення в нашому суспільстві. Саме поняття медіації не є новим для нашого суспільства, проте, як свідчить аналіз літератури й інших джерел, у нашій державі медіація використовується напрочуд рідко, на відміну від інших європейських держав. Недовіру в нашій державі до ефективності застосування медіації можна обумовити відсутністю донедавна закону, який би регулював процедуру медіації та її наслідки. Звертається увага на те, що правники більше зосереджуються на технологіях медіації як альтернативному способі вирішення конфліктів. Значно меншу увагу приділяють медіації як інструмента ефективного укладення договорів (угод). Some aspects of the implementation of the institute of mediation in Ukraine have been considered in the article. It is noted that mediation as a new and uncharacteristic legal institution for Ukraine has not yet become widespread in our society. The very concept of mediation is not new to our society, but according to the analysis of literature and other sources, mediation in our country is used surprisingly rarely, unlike in other European countries. Distrust in our country to the effectiveness of mediation can be attributed to the lack of until recently a law that would regulate the mediation procedure and its consequences. Attention has been drawn to the fact that lawyers are more focused on mediation technologies as an alternative way to resolve conflicts. Much less attention has been paid to mediation as a tool for effective conclusion of contracts (agreements). | |
