| dc.description.abstract | Стаття присвячена дослідженню основних підходів до визначення поняття «позитивна дискримінація» в роботах науковців та в нормативноправових актах. В статті розглянуто основні наукові та законодавчі трактування поняття позитивної дискримінації вітчизняних та європейських вчених, в контексті законодавства відповідних країн та в порівнянні з поняттями «дискримінація» та «дискримінаційне ставлення». В статті поняття позитивної дискримінації розглядається як самостійна дефініція, як метод забезпечення принципу рівності та як модель позитивних обов’язків держави. This article is devoted to the research of the basic approaches to the definition of «positive discrimination» in the works of scientists and in the normative-legal acts. This article reviews the main scientific and legislative interpretations of the concept of positive discrimination of domestic and European scientists, in the context of the legislation of the relevant countries and in comparison with the concepts of «discrimination» and «discriminatory attitude». The article considers the notion of positive discrimination as a self-definition, as a method of ensuring the principle of equality and as a model of positive obligations of the state. | |
