| dc.description.abstract | Наукову статтю присвячено дослідженню проблеми, що є запорукою повноцінного та якісного функціонування механізму нашої держави, стабільного розвитку усіх сфер суспільного життя, а саме відповідальному відношенню службових осіб до виконання покладених на них повноважень. Метою статті є – дослідити існуючі проблеми щодо законодавчої конструкції статті 367 КК України та унормувати кримінальне законодавство з метою усунення існуючих прогалин. Проаналізовано статтю 367 Кримінального кодексу України «Службова недбалість», соціальну зумовленість її існування та недоліки законодавчої конструкції. The scientific article is devoted to the study of the problem, which is the key to the full and qualitative functioning of the mechanism of our state, the stable development of all spheres of public life, namely the responsible attitude of official persons to the fulfillment of their powers. The purpose of the article is to investigate the existing problems in the legislative design of article 367 of the Criminal Code of Ukraine and to normalize criminal legislation in order to fill existing gaps. Article 367 of the Criminal Code of Ukraine “Official negligence”, the social conditionality of its existence and the shortcomings of the legislative structure, has been analyzed. | |
