| dc.description.abstract | На підставі проведених досліджень, автором відзначається важливий зв’язок запровадження виокремлених у статті механізмів із підвищенням невідворотності юридичної відповідальності у конкурентному праві. За результатами дослідження наводяться обґрунтовані висновки щодо користі імплементації механізмів субсидіарної відповідальності у конкурентному праві України, що полягатимуть у: швидкості прийняття регулятором рішень про застосування штрафних санкцій з огляду на спрощення процедури доведення факту здійсненого правопорушення; швидкості сплати самих штрафних санкцій; коригуванні подальшої поведінки всієї групи суб’єктів господарювання-порушників, оскільки така буде виправлятися самим контро- люючим суб’єктом господарювання, який здійснює вирішальний вплив на всю групу; підвищенні дієздатності інших учасників ринку компенсувати власні збитки внаслідок допущених порушень законодавства у сфері економічної конкуренції, що також сприятливо впливатиме на збільшення суспільного контролю за конкуренцією. На переконання автора, унікальність становища України у питанні модернізації власного господарського законодавства дає можливість застосувати досвід імплементації як інституту субсидіарної відповідальності у конкурентному праві, так і правозастосовчої доктрини «зняття корпоративної вуалі», що у комплексі дозволить наблизитися до більш вільних конкурентних ринків. A scientific-historical insight to the foundations for the emergence of subsidiary liability institution was conducted. The origin and approaches of defining the legal liability inevitability concept were analyzed linking that with the importance of observing this concept on a path to improve law enforcement practice and legislation in the field of economic competition. The functional purpose of the of subsidiary liability institution, as a component of increasing the effectiveness of applying the fundamental law principle of legal liability inevitability, which has a significant impact for competition law, was also defined. Conclusions. Based on the results of the research, reasonable conclusions were given in regard of the benefits of vicarious liability mechanisms implementing within the competition law of Ukraine, which may beneficially effect on: the speed of decision-making by the regulator on the application of fines in view of the simplification of the procedure for proving the fact of the offense committed by the group of undertakings; speed of payment of fines itself; adjustment of the subsequent behavior of the entire group of undertakings violating competition rules, since it will be corrected by the controlling undertaking itself, which carries out a decisive impact on the entire group; increasing the capacity of other market participants to compensate for their own losses as a result of committed violations of competition rules, which will also have a beneficial effect on the level of public control over competition. In opinion of author, the uniqueness of Ukraine’s position in the issue of modernization of its own economic legislation gives an opportunity to apply the experience of implementation of vicarious liability institution in competition law, as well as the law enforcement doctrine of “piercing the corporate veil”, which in the complex will allow to get closer to competitive free markets. | |
