| dc.description.abstract | У статті приділяється увага дослідженню питання ролі судової практики у правовій системі України. Розглянуто окремі поняття правової системи. Проаналізовано підходи до визначення структури правової системи. Зроблено висновок, що судова практика виступає окремим самостійним елементом правової системи. Проаналізовано запропоновані науковцями визначення судової практики. Проаналізовано значення судової практики як елемента правової системи України. Додатково автором звернуто увагу на такий феномен судової правотворчості як «негативна правотворчість», що полягає у винесенні органами судової влади рішень, які скасовують дію юридичної норми, визнаючи їх неконституційними та протиправними. The article focuses on research on the role of judicial practice in the legal system of Ukraine. Some concepts of the legal system are considered. Approaches to determining the structure of the legal system are analyzed. It is concluded that judicial practice is a separate independent element of the legal system. The definitions of judicial practice proposed by scientists are analyzed. The importance of judicial practice as an element of the legal system of Ukraine is analyzed. Additionally, the author draws attention to such a phenomenon of judicial lawmaking as «negative lawmaking», which consists in the issuance by the judiciary of decisions that repeal the legal norm, declaring them unconstitutional and illegal. | |
