| dc.description.abstract | В умовах становлення демократичного суспільства в Україні неможна обійти стороною право на захист прав, свобод та інтересів особи під час здійснення правосуддя в цивільних справах. З метою утвердження верховенства права при здійсненні захисту прав відбулося реформування цивільного судочинства. Виступаючи гарантом права на звернення особи до суду за захистом своїх порушених, невизнаних або оспорюваних прав, свобод чи інтересів, держава встановлює процедури його реалізації. In the conditions of a developing democratic society in Ukraine, the right to protection of the person’s rights, freedoms and interests during the judicial proceedings in civil cases cannot be left unaddressed. The civil justice system was reformed for the purpose of asserting the supremacy of law when protecting one’s rights. By acting as the guarantor of the person’s right to seek judicial protection of their violated, unrecognized or disputed rights, freedoms or interests, the state establishes the procedures of exercising the said right. In particular, the state obliges courts to admit applications for consideration even if the law does not contain a special provision concerning judicial protection. | |
