| dc.description.abstract | Наукова стаття присвячена дослідженню та комплексному аналізу правового звичаю як основі укладення та розірвання шлюбу в Україні XVIII-XX століття. З урахуванням доктринального дослідження констатовано, що дав- ньослов’янські уявлення про шлюб як про договір між батьками нареченого і нареченої були досить неоднозначні, адже батьківський авторитет і батьківське слово продовжувало залишатися у більшості першою і останньою умовою при вирішенні питання про укладення шлюбу, але, тим не менш, дія окремих указів, які стали прийматися у XVIII столітті стало одним з кроків, спрямованих на захист дітей від батьківського свавілля у родині.
