| dc.description.abstract | У статті досліджуються питання, пов’язані з участю третіх осіб у цивільно-правовому зобов’язанні. Автором проаналізовано положення законодавства, погляди вчених з зазначеної проблематики, а також зроблено висновки з указаного питання. У сучасних умовах розвитку договірних відносин виконання зобов’язання особисто сторонами у багатьох випадках є радше винятком, ніж загальним правилом. Цивільному праву відомі випадки впливу третьої особи на зобов’язальні відносини кредитора та боржника. За загальним правилом, встановленим у ст. 511 ЦК України, зобов’язання не створює обов’язку для третьої особи. У випадках, встановлених договором, зобов’язання може породжувати для третьої особи права щодо боржника та (або) кредитора. The article сoncerns the issues related to the involvement of third parties in civil legal liability. The author analyzes the provisions of the legislation, the views of scientists on the subject, and draws conclusions on this issue.In the current context of contractual relations, the fulfillment of obligations by the parties in many cases is, in many cases, the exception rather than the general rule. Civil law is known as a case of influence of a third party on the obligations of the creditor and the debtor. According to the general rule established in Art. 511 of the Civil Code of Ukraine, the obligation creates no liability for a third party. In the cases established by the agreement, the obligation may give rise to rights for the third party against the debtor and (or) the creditor. | |
