Abstract
Законодавче регулювання процесуального статусу та порядку залучення перекладача, підстав та порядку його відводу є сталим – з моменту набуття чинності КПК 2012 р. воно не зазнавало змін і доповнень. Ця стабільність зумовлена не тим, що правове регулювання (ст. 29, 68, 79, 224 КПК України) є досконалим і не породжує правозастосовних проблем, а тим, що воно сформульоване найзагальнішим чином і тому є пластичним для найрізноманітніших казусів, вирішення яких відведено суб’єкту, який веде процес. Але наслідком такого регулювання є й розбалансованість практики у вирішенні аналогічних ситуацій – найтиповіше щодо компетентності перекладача і її перевірки, його підшукання та процесуального оформлення його залучення, обсягу перекладу матеріалів провадження, відводу або заміни перекладача. Підходи щодо цих питань треба універсалізувати. Legislative regulation of the procedural status and procedure for involving an interpreter, the grounds and procedure for his removal is permanent in Ukraine. The legislation has not been amended since the entry into force of the CPC in 2012. This stability is due not to the fact that the legal regulation (Articles 29, 68, 79, 224 of the CPC of Ukraine) is perfect and does not create law enforcement problems, but to the fact that it is formulated in the most general way and therefore creates unresolved situations. In addition, such legislation makes an imbalance of practice in resolving similar situations – most typical in cases concerning the competence of the interpreter and its verification, the procedure of its involvement, the amount of translation of criminal proceedings materials, removal or replacement of the interpreter. Approaches to these issues need to be generalized.
