Abstract
Мета статті – проаналізувати становлення законодавства про статус іноземців та осіб без грома-дянства в Україні; дослідити праці вчених і законодавчі акти, прийняті після проголошення неза-лежності Україні, та міжнародні акти, що регламентують правовий статус іноземців та осіб без громадянства; схарактеризувати основні нормативно-правові акти, якими визначено терміни «іноземець», «біженець», «особа, яка потребує додаткового захисту», «особи, які потребують тимчасового захисту», «імміграція»; розглянуто права та обов’язки іноземців в Україні; надати пропозиції щодо вдосконалення законодавства в умовах європейської інтеграції України. Висновки. Законодавство про статус іноземців складається із законів України «Про правовий статус іноземців та осіб без громадянства», «Про біженців та осіб, які потребують додаткового або тимчасового захисту» та «Про імміграцію». Автор зауважив, що відсутній єдиний нормативно-правовий документ, яким має визначатися правовий статус іноземця, його права та обов’язки,
питання імміграції та правовий статус шукачів захисту. У науковій літературі та правничих дискусіях не порушувалося питання кодифікації законодавства про статус іноземців. The purpose of the article is to analyze the development of legislation on the status of foreigners and stateless
persons in Ukraine. The works of scientists and legislative acts adopted after the proclamation of Ukraine’s independence and international acts regulating the legal status of foreigners and stateless persons are analyzed. The main normative – legal acts are defined, which define «foreigner», «refu-gee», «person in need of additional protection», «persons in need of temporary protection», «immig-ration»; the rights and obligations of foreigners in Ukraine are considered. Provide proposals for impro-ving the legislation in the context of Ukraine’s European integration. Conclusions. Legislation on the status of foreigners consists of the Law of Ukraine «On the Legal Status of Foreigners and Stateless Persons», the Law of Ukraine «On Refugees and Persons in Need of Additional or Temporary Protec-tion», the Law of Ukraine «On Immigration». The author points out that there is no single legal document that should determine the legal status of a foreigner, his rights and responsibilities, immigration issues and the legal status of asylum seekers. The issue of codification of legislation on the status of foreigners was not raised in the scientific literature and legal discussions.
