Abstract
У статті розглянуто вплив обстановки на формування суспільно небезпечного характеру діяння на прикладі деяких кримінальних правопорушень. З’ясовано вплив обстановки вчинення діяння на його суспільну небезпечність, який може залежати від форми посягання – шляхом дії (активної поведінки) або шляхом бездіяльності (пасивної поведінки). Доведено, що значення обстановки вчинення кримінального правопорушення може полягати в тому, що вчинення в умовах певних видів обстановки відповідного діяння надає йому якості кримінально протиправного, хоча при цьому обстановка не має безпосереднього стосунку до настання суспільно небезпечних наслідків і сама не зазнає будь-яких небажаних змін. The article considers the influence of the situation on the formation of socially dangerous nature of the action on the example of some criminal offenses. The influence of the circumstances of the action on its social danger, which may depend on the form of encroachment – by action (active behavior), or by inaction (passive behavior). It is proved that the significance of the circumstances of a criminal offense may be that the commission of a relevant action in certain circumstances gives it the quality of a criminal offense, although the situation is not directly related to the occurrence of socially dangerous consequences and does not undergo any undesirable changes.
