dc.description.abstractНа практиці доволі часто трапляються випадки, коли позивач звертається до суду, що не має повноважень розглядати від-повідну цивільну справу. Порушення правил підсудності приз-водить до того, що особа (наприклад, відповідач) позбав-ляється можливості розгляду її справи саме в уповноважено-му суді як «суді, встановленому законом», що є порушенням ст. 6 Конвенції про захист прав людини і основоположних сво-бод. Підсудність як правове явище має не лише статичний ас-пект, а й динамічний, що розкривається при реалізації права на судовий захист в сфері цивільної юрисдикції. In practice, there are often cases where the plaintiff goes to court that does not have the authority to hear the relevant civil case. Violation of the rules of jurisdiction leads to the fact that a person (for exam-ple, the defendant) is deprived of the opportunity to consider his case in an authorized court as a «court established by law»,which is a violation of Art. 6 of the Convention for the Protection of Hu-man Rights and Fundamental Freedoms. Jurisdiction as a legal phenomenon has not only a static aspect but also a dynamic one, which is revealed in the exercise of the right to judicial protection in the field of civil jurisdiction.uk_UA
