| dc.description.abstract | В статті здійснено дослідження завдань інституту підготовчого провадження через призму завдання цивільного судочинства та виявлення основних рис даної процесуальної стадії, що є характерними для її правової природи. Необхідність підготовки справи до судового розгляду в процесуальній науці завжди визнавалась невід’ємною та необхідною стадією будь-якої галузі процесуального права. Цілком зрозуміло, що без якісної підготовки справи до її подальшого вирішення в судовому засіданні, неможливо досягти не лише виконання основного завдання цивільного судочинства, але і взагалі – відновити порушені, невизнані або опорювані право, свободу чи інтерес. The article examines the tasks of the institute of preparatory proceedings through the prism of the task of civil proceedings and identifies the main features of this procedural stage, which are characteristic of its legal nature. The need to prepare a case for trial in procedural science has always been recognized as an integral and necessary stage of any branch of procedural law. It is clear that without quality preparation of the case for its further resolution in court, it is impossible not only to achieve the main task of civil proceedings, but in general – to restore violated, unrecognized or challenged rights, freedoms or interests. | |
