| dc.description.abstract | У статті досліджені питання класифікації принципів інформаційного права. Автор зауважує, що єдиного погляду на класифікацію принципів інформаційного права серед вітчизняних учених немає. Однак залежно від сфери застосування принципи інформаційного права можна поділити на загальноправові, міжгалузеві та галузеві. Автор статті наголошує на тому, що Законом України «Про інформацію» закладена система принципів правового регулювання відносин у сфері інформації, яка може бути використана як основа галузевих принципів інформаційного права. На думку автора статті, у майбутньому Інформаційному кодексі України мають бути відображені такі принципи: гарантованість права на інформацію; забезпечення рівних можливостей щодо створення, збирання, одержання, зберігання, використання, поширення, охорони й захисту інформації; відкритість, доступність інформації, свобода обміну інформацією; забезпечення інформаційної безпеки; достовірність і повнота інформації; свобода вираження поглядів і переконань; заборона цензури інформаційної діяльності; правомірність одержання, використання, поширення, зберігання та захисту інформації; захищеність особи від втручання в її особисте й сімейне життя. The article deals with the issues of classification of the information law principles. The author observes that there is no single point of view on the classification of the information law principles among Ukrainian scientists. But, depending on the scope of application, the classification of principles is commonly recognized, which divides them into common law, inter-branch, and sectoral principles. The author stresses that Ukrainian Law “On Information” contains a system of princi- ples of legal regulation of relations in the field of information, which can be used as the basis of sectoral information law principles. According to the author of the article, in the future, the Information Code of Ukraine should reflect the following principles: guaranteeing the right to information; provision of equal opportunities for the creation, collection, reception, storage, use, dissemination, protection of information; openness, accessibility of information, freedom of information exchange; pro- vision of information security; reliability and completeness of information; freedom of expression and belief; prohibition of censorship of information activity; the legality of obtaining, using, disseminating, storing and protecting information; the protection of the person from interference in her personal and family life. | |
