| dc.description.abstract | Стаття присвячена особливостям формування правових позицій Верховного Суду у кримінальному провадженні. Автор доходить висновку, що на формування правових позицій Верховного Суду впливають такі фактори: Конвенція про основоположні права і свободи людини, практика Європейського суду з прав людини; рішення, висновки Конституційного Суду України; правові позиції щодо застосування норми права в подібних правовідносинах, викладені в раніше ухваленому рішенні Верховного Суду, Верховного Суду України; суддівський розсуд. Також запропоновано визначення поняття «формування правових позицій Верховного Суду у кримінальному провадженні». The article is devoted to the peculiarities of formation of the legal positions of the Supreme Court. The author comes to the conclusion that process of formation of legal position of the Supreme Court is influenced by the Convention for the Protection of Human Rights and Fundamental Freedoms, practice of the European Court of Human Rights; decisions, conclusions of the Constitutional Court of Ukraine; legal positions about application legal provisions in like relationship that have been formed in previously taken decisions by the Supreme Court, the Supreme Court of Ukraine; judicial discretion. A definition of the concept of “process of formation legal positions of the Supreme Court in criminal proceeding” was suggested. | |
