Abstract
У статті розкрито особливості правового регулювання вивезення дітей з України в умовах воєнного стану та вирішення спорів щодо їх повернення. Проаналізовано правове регулювання вивезення дітей за межі України до 24 лютого 2022 року та після ведення воєнного стану на території України. Розглянуто основні аспекти врегулювання процесу повернення дитини до України відповідно до Конвенції про цивільно-правові аспекти міжнародного викрадення дітей, що забезпечує процес, за допомогою якого батьки можуть повернути свою дитину до рідної країни між договірними державами. Тhe article reveals the peculiarities of the legal regulation of the removal of children from Ukraine in conditions of martial law and the dispute resolution concerning their return. The legal regulation of the removal of children from Ukraine until February 24, 2022, and after the imposition of martial law on the territory of Ukraine is analysed.
The main aspects of the regulation of the process of returning a child to Ukraine in accordance with the Convention on Civil Legal Aspects of International Child Abduction are considered.
