| dc.description.abstract | Стаття присвячена дескрипції окремих підходів оптимізації балансу процесуальних можливостей сторони обвинувачення та сторони захисту у кримінальному провадженні. Під поняттям «процесуальних можливостей» розуміється сукупність прав та повноважень щодо застосування процесуальних інститутів для відстоювання сторонами своїх правових позицій перед незалежним і справедливим судом. Важливість обговорення цієї теми зумовлена низкою чинників. Процесуальні права та повноваження залишаться декларацією на папері, якщо не існуватимуть реальні фактичні можливості скористатися ними сторонами для відстоювання правових позицій на засадах змагальності. The purpose of the article is to describe some approaches to the issue of improving the balance of procedural opportunities for the prosecution and the defense in criminal proceedings. The concept of “procedural opportunities” means a set of rights and powers for the application of procedural institutions during the presentation by parties of their legal positions before an independent and fair court. The importance of discussing this topic is determined by a number of factors. Procedural rights and powers will remain a declaration on paper if there are no real opportunities to use them. At the same time, reforms in this area must be treated with great care, because efforts to balance the system can sometimes lead to the opposite effect. | |
