| dc.description.abstract | У статті проведено порівняльний аналіз змісту поняття трудового договору, зазначеного в чинному законодавстві та проекті Трудового Кодексу України. Доведено, що обов’язковість трудового контракту буде вважатися позитивною передумовою в Трудовому Кодексі України. Виявлено та досліджено характеристику суб’єктів трудового права та трудового договору зокрема. Запропоновано додати до проекту ТК України вимоги до працівників, як одну з складових проекту, які можуть включати вимоги щодо якості працівника як професіонала, вимоги до стану здоров’я, віку, вимоги, які стосуватимуться моральних, етичних якостей працівника, його громадянства, знання державної мови, й окремо вимоги, які можуть бути встановлені роботодавцем. The article deals with the comparative analysis of the content of the concept of the employment contract specified in the current legislation and the draft Labor Code of Ukraine. It is proved that the obligation of an employment contract will be considered as a positive prerequisite in the Labor Code of Ukraine. The characteristics of the subjects of labor law and the employment contract in particular have been identified and investigated. It is proposed to add to the draft TC of Ukraine requirements for employees as one of the components of the project, which may include requirements for the quality of the employee as a professional, requirements for the state of health, age, requirements that will relate to the moral, ethical qualities of the employee, his citizenship, knowledge state language and separately the requirements that can be set by the employer. | |
