| dc.description.abstract | У статті досліджується сутність правових цінностей Європейського Союзу, їх нормативно-правове закріплення в установчих документах цієї міжнародної організації. Встановлено, що у комунітарному праві цінності ЄС це головні імперативи, орієнтири та морально-етичні начала євроінтеграції, що набули значення нормативних приписів. Використання цього терміну покликано підкреслити, що європейське інтеграційне об’єднання і створюване на його основі право мають відповідати моралі. Установлено, що фіксація цінностей у первинних джерелах ЄС має першочергово ідеологічне значення, оскільки через них здійснюється формування, актуалізація, спрямування та виправдання одних напрямів діяльності Союзу та його держав-членів і засудження інших. Визначено, що до базових правових цінностей Союзу відносяться: людська гідность, свобода, демократія, рівність, верховенство права, повага до прав людини, зокрема осіб, що належать до меншин, плюралізм, недискримінація, толерантність, справедливість, правосуддя, солідарність та рівність жінок і чоловіків. The article examines the essence of the legal values of the European Union, their normative and legal consolidation in the founding documents of this international organization. It was established that in the communitarian law of EU values, these are the main imperatives, guidelines and moral and ethical principles of European integration, which have acquired the meaning of normative prescriptions. The use of this term is intended to emphasize that the European integration association and the law created on its basis must correspond to morality. It has been established that the fixation of values in the primary sources of the EU has a primary ideological significance, because through them the formation, actualization, direction and justification of some areas of activity of the Union and its member states and condemnation of others are carried out. It was determined that the basic legal values of the Union include: human dignity, freedom, democracy, equality, the rule of law, respect for human rights, in particular those belonging to minorities, pluralism, non-discrimination, tolerance, justice, justice, solidarity and equality of women and men. | |
