| dc.description.abstract | У статті розглянуто види гарантій реалізації конституційної свободи особи на підприємницьку діяльність. Автори їх поділяють на: а) правові (В. Погорілко, В. Федоренко); б) юридичні (П. Глущенко); в) загальні та спеціальні (П. Рабінович, В. Сіренко, О. Скакун, О. Совгиря, М. Хавронюк, Н. Шукліна); г) загальні та правові (К. Волинка) та ін. Можна стверджувати, що усі автори не заперечують того факту, що гарантії конституційних прав і свобод – це умови і засоби їх забезпечення реалізації. Не заперечується ними й поділ гарантій на загальні та спеціальні, а також і те, що вони закріплюються Конституцією і законами України, є гарантіями як конституційних прав, так і конституційних свобод, включаючи і конституційну свободу особи на підприємницьку діяльність. The article deals with the types of guarantees for the realization of a person’s constitutional freedom for business activities. The authors divide them into: a) legal (V. Pogorilko, V. Fedorenko); b) legal (P. Glushchenko); c) general and special (P. Rabinovich, V. Sirenko, O. Skakun, O. Sovgyrya, M. Khavroniuk, N. Shuklina); d) general and legal (K. Volynka) and others. It can be argued that all authors do not deny the fact that guarantees of constitutional rights and freedoms are the conditions and means of ensuring their implementation. There is no denying that the division of guarantees into general and special ones, as well as the fact that they are enshrined in the Constitution and laws of Ukraine, are guarantees of both constitutional rights and constitutional freedoms, including the constitutional freedom of a person to do business. | |
