| dc.description.abstract | У статті досліджено підстави та принципи криміналізації діянь проти власності. Криміналізація відбувається шляхом з’ясування цілей, підстав становлення кримінальної відповідальності за діяння, вчинене проти власності. На підставі цього формується сукупність норм кримінального права, які містять перелік злочинів і передбачених за них покарань, а також підстав та умов притягнення до кримінальної відповідальності винних осіб чи звільнення від неї. Основними підставами криміналізації діянь проти власності є те, що суспільні відносини власності як частина економічних відносин складають основу функціонування будь-якого суспільства, розвиток якого неможливий без забезпечення належного захисту власності, прав власника від будь-яких незаконних посягань. The article explores the grounds and principles of criminalization of acts against property. Criminalization occurs by finding out the purposes, grounds for criminal liability for an act against property. On this basis, a set of criminal law norms is formed, which contains the list of crimes and the punishments provided for by them, as well as the grounds and conditions for bringing to justice or acquitting perpetrators. The main grounds for criminalizing acts against property are that public property relations, as part of economic relations, form the basis of the functioning of any society, the development of which is impossible without proper protection of property, the rights of the owner against any unlawful encroachment. | |
