Abstract
У статті досліджено механізм захисту прав людини у Європейському суді з прав людини (далі – ЄСПЛ), його договірно-правові засади, передумови формування, сучасний стан та перспективи розвитку. Доведено, що система джерел організації та діяльності ЄСПЛ систематично набуває нових аспектів у зв’язку із нормативно-правовим оформленням та конкретними перетвореннями. Визначено перспективи функціонування ЄСПЛ та можливі інституціональні реформи, які можуть докорінно змінити структуру досліджуваної міжнародної судової інституції. The article examines the mechanism of human rights protection in the European Court of Human Rights (further – ECHR), its contractual and legal principles, prerequisites for its formation, current state and prospects for development. It is proven that the system of sources of organization and activity of the ECHR systematically acquires new aspects in connection with regulatory and legal design and specific transformations. The perspectives of the functioning of the ECHR and possible institutional reforms that can fundamentally change the structure of the studied international judicial institution are determined.
