| dc.description.abstract | Стаття присвячена аналізу теоретичних та практичних проблем, які стосуються підстав та умов обрання запобіжних заходів у вигляді домашнього арешту та особистої поруки. На підставі аналізу положень чинного КПК України, правових позицій Європейського суду з прав людини (далі – ЄСПЛ) та вітчизняної судової практики визначено коло обставин, якими має обґрунтовуватися висновок слідчого, прокурора, слідчого судді, суду про наявність/відсутність ризиків (ризику), які є однією з підстав для застосування запобіжних заходів. The article is devoted to the analysis of theoretical and practical problems concerning the grounds and conditions for application preventive measures in the form of house arrest and personal guarantee. On the basis of the analysis of the legal rules of the Code of Criminal Procedure 2012, the practice of the European Court of Human Rights (ECtHR) and the practice of domestic courts a number of circumstances, which should justify the conclusion of an investigator, prosecutor, investigating judge, court on the presence/absence of risk (risk), which is one of the grounds for applying precautionary measures have been identified. | |
