| dc.description.abstract | Статтю присвячено заборонам окремих видів конституційної свободи особи на підприємницьку діяльність. Досліджено наукові праці та нормативно-правові акти щодо названих заборон. Ознаками заборон названої конституційної свободи є : а) закріплення нормами Конституції та законів; б) монополія держави на певні види товарів і послуг; в) ліцензування певних видів господарської діяльності; г) заборони на окремі види підприємництва. Заборони окремих видів конституційної свободи фізичної особи на підприємницьку діяльність – це урегульована нормами Конституції та законів України господарська діяльність, на яку поширюється монополія держави щодо виготовлення та реалізації товарів і послуг, які можуть здійснюватися тільки державними підприємствами, та отримання ліцензій на окремі види підприємництва. The article is devoted to the prohibitions of certain types of constitutional freedom of a person to entrepreneurial activity. Scientific works and normative-legal acts concerning the mentioned prohibitions are investigated. Signs of prohibitions of the named constitutional freedom are: a) fixing by norms of the Constitution and laws; b) the state monopoly on certain types of goods and services; c) licensing of certain types of economic activity; d) bans on certain types of entrepreneurship. Prohibitions of certain types of constitutional freedom of an individual to entrepreneurial activity are regulated by the norms of the Constitution and laws of Ukraine economic activity to which the state monopoly on production and sale of goods and services can be carried out only by state enterprises and obtaining licenses for certain types of entrepreneurship. | |
