Abstract
У статті розглядається встановлений порядок отримання зразків для експертизи у кримінальному провадженні як відповідний засіб доказування. Розглядаються види зразків для експертизи, які виділяє законодавець, та процесуальний порядок їх отримання. За результатами аналізу виділених законодавцем видів зразків для експертизи робиться висновок про відсутність регламентованого порядку отримання зразків з тіла неживої людини (трупа). Обґрунтовується думка про необхідність виділення зразків з тіла неживої людини (трупа) в окремий вид зразків для експертизи, зважаючи на виокремлення трупа законодавцем (на прикладі інших слідчих (розшукових) дій) як специфічної процесуальної категорії, відмінної від речей, документів, особи, – процесуальний порядок отримання зразків з яких встановлений законодавцем. The article considers the established procedure for obtaining samples for examination in criminal proceedings as an appropriate means of proof. The types of samples for examination, which are allocated by the legislator, and the procedural order for obtaining them are considered. Based on the results of the analysis of the types of samples selected by the legislator for examination, it is concluded that there is no regulated procedure for obtaining samples from the body of an inanimate person (corpse). The idea of the need to select samples from the body of an inanimate person (corpse) in a separate type of samples for examination, given the separation of the corpse by the legislator (on the example of others investigative actions) as a specific procedural category other than things, documents, person – the procedure for obtaining samples from which is established by the legislator.
